Terms & Conditions

Effective August 2026

1. About these Terms

These Terms & Conditions apply to the use of the Pinion Institute website and purchases made through its online store.

Pinion Institute is an Australian business based in Queensland. Twelve Feathers Press is a publishing imprint of Pinion Institute.

By using this website or placing an order, you agree to these Terms to the extent applicable to your use or purchase.

Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

2. Website Use

You may use this website for lawful purposes. You must not use it in a way that infringes another person's rights, interferes with the operation or security of the website, or involves unlawful, fraudulent or misleading activity.

We may reasonably restrict access where necessary to protect the security, integrity or lawful operation of the website.

3. Products

Products offered through the online store may include publications, digital products, educational and creative resources, merchandise and other physical or digital goods.

We take reasonable care to describe products accurately. Relevant information, including format, dimensions, materials or other characteristics where applicable, will be provided in the product listing.

Images of physical products are illustrative, and minor variations may occur due to materials, production processes, photography or electronic display. Nothing in this section limits any rights or remedies available under the Australian Consumer Law.

4. Orders

Submitting an order constitutes an offer to purchase the products identified in the order at the stated price, subject to these Terms.

An automated acknowledgement confirms receipt of your order. An order is accepted when payment has been successfully processed and the order is confirmed, subject to circumstances in which we are genuinely unable to supply the product.

We may be unable to accept or fulfil an order where a product is unavailable, payment cannot be processed, required information is materially incomplete or incorrect, there is an evident pricing or listing error, or fulfilling the order would be unlawful.

If we cannot fulfil an order after payment has been received, we will refund the amount paid for the affected product or order.

5. Prices and Payment

Prices are displayed in Australian dollars (AUD) unless otherwise stated.

Pinion Institute is not currently registered for Goods and Services Tax (GST), and GST is not charged on purchases.

The total amount payable, including any applicable delivery or other disclosed charges, will be shown before an order is submitted.

Payment is processed using the payment methods available through the website at the time of purchase.

6. Digital Products

Unless the relevant product listing or licence states otherwise, purchasing a digital product grants the purchaser a non-exclusive, non-transferable licence to use the supplied copy for personal use.

Purchase does not transfer copyright or other intellectual property rights in the work.

Except as permitted by law or expressly authorised by the relevant rights holder, digital products must not be reproduced or distributed to others, publicly uploaded, resold, sublicensed or commercially exploited.

Where institutional, educational, classroom or other multiple-user use is required, please contact Pinion Institute regarding appropriate permission or licensing.

Nothing in these Terms restricts any use permitted under the Copyright Act 1968 (Cth) or other applicable law.

7. Digital Delivery

Digital products will ordinarily be made available electronically following successful payment using the delivery method specified during purchase.

You are responsible for providing accurate information required for digital delivery and for meeting any technical requirements clearly identified before purchase.

If you experience a genuine problem receiving or accessing a purchased digital product, please contact Pinion Institute so that the issue can be investigated and an appropriate remedy provided where required.

8. Physical Products and Delivery

Available delivery methods and applicable charges for physical products will be displayed during the purchasing process.

You are responsible for providing accurate delivery information.

Any stated dispatch or delivery period is an estimate unless expressly identified as a guaranteed commitment. We will take reasonable steps to supply products within the stated period or, where no period is stated, within a reasonable time.

If a product cannot be supplied, we will provide an appropriate remedy, which may include a refund.

9. Returns, Refunds and Consumer Rights

Products purchased through this website come with rights and guarantees that may apply under the Australian Consumer Law. Nothing in these Terms or our other policies excludes or restricts those rights.

We are not required to provide a refund or replacement solely because a purchaser changes their mind. Any change-of-mind arrangements we offer are set out in our Return Policy.

Because digital products can ordinarily be accessed or retained once supplied, we do not ordinarily provide change-of-mind refunds after a digital product has been supplied or made available for download.

This does not limit any right or remedy available under the Australian Consumer Law.

Further information is provided in our Return Policy and Digital Product Policy.

10. Intellectual Property

Unless otherwise stated, copyright and other intellectual property rights in original website content and products published or produced by Pinion Institute or Twelve Feathers Press remain with the relevant rights holder.

This may include publications, written material, artwork, illustrations, diagrams, photographs, educational resources, designs and other original material.

Access to the website or purchase of a product does not transfer ownership of those intellectual property rights. Material may be used only as authorised by the applicable product licence, the relevant rights holder or applicable law.

11. Third-Party Services

The website may use or link to third-party services, including services involved in payment processing, website functionality or fulfilment. The terms and privacy practices of those providers may apply when you use their services.

We are not responsible for independent third-party websites merely because this website links to them. Nothing in this section excludes responsibility that cannot lawfully be excluded.

12. Liability

Nothing in these Terms excludes, restricts or modifies any liability, right or remedy where doing so would be unlawful, including under the Australian Consumer Law.

To the extent permitted by law, Pinion Institute is not liable for loss or damage arising from circumstances outside its reasonable control, except to the extent that such liability cannot lawfully be excluded or limited.

13. Privacy

Personal information collected through the website and online store is handled in accordance with our Privacy Policy and applicable Australian law.

14. Changes to these Terms

We may update these Terms to reflect changes to our business, website, products or applicable law. Updated Terms apply from the date they are published.

Changes will not retrospectively alter the terms governing a completed purchase unless required by law or agreed with the purchaser.

15. Governing Law

These Terms are governed by the laws applicable in Queensland and the Commonwealth of Australia.

Nothing in this provision limits any statutory right available to a consumer under applicable law.
